Deviating terms of the customer are only valid if we have agreed to them in writing. Individual agreements require written confirmation.
2. Offers and contract
Information on this website is not a binding offer. Product images are illustrations; the specifications in the respective quotation or order confirmation apply. A contract is concluded with our written order confirmation or with delivery. For custom-made products, special requests and pre-orders, individual terms are agreed before the contract is signed.
3. Prices and payment
All prices are net, plus statutory VAT, transport, delivery and, where applicable, customs costs. Products in stock are shipped after 100% payment has been received. For products that have to be ordered or produced, payment is staggered: 30% deposit with the order, 30% before shipping from the factory, and the balance before delivery, unless agreed otherwise. Payment is by bank transfer. In case of late payment, default interest and the costs of necessary legal representation are charged.
4. Delivery and transfer of risk
Delivery times are given as accurately as possible; production of made-to-order equipment typically takes one week to one month, delivery four to six weeks. We are not liable for delays that were not caused by gross negligence or intent on our part. Goods remain our property until full payment of all outstanding amounts.
5. Installation, training and support
Where agreed, installation, operator training and technical support are provided as described in the quotation. Equipment should be installed by qualified personnel and used according to the manufacturer’s instructions.
6. Warranty
Machines come with a one-year warranty as standard, unless agreed otherwise. The period for asserting statutory warranty claims is six months from delivery. The customer must inspect the goods immediately on receipt and report defects in writing within one week. Damage caused by improper use, natural wear or external factors (such as power supply or ingredients) is not a defect.
7. Liability
We are not liable for indirect damage, consequential damage or lost profit unless caused by gross negligence or intent. This does not apply to personal injury.
8. Applicable law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the competent court in Schwaz, Austria.
